1. Introduction

These Terms and Conditions ("Terms") govern your use of the Setian platform and related services ("Service") operated by Devcon Solutions (Pty) Ltd ("we", "us", or "our"). By accessing or using our Service, you agree to be bound by these Terms.

If you do not agree with any part of these Terms, you may not use the Service.

2. Description of Service

Setian provides an AI-powered school communication and information platform. The Service aggregates school communications and data, enabling parents and guardians to access relevant school information through a conversational AI interface.

3. Account Registration and Authentication

To access the Service, you must authenticate using your mobile phone number. We use a one-time password (OTP) sent via SMS to verify your identity. By providing your phone number, you consent to receiving OTP messages for authentication purposes.

Your phone number is used solely for authentication and is not shared with third parties for marketing or other purposes. We do not collect personally identifiable information beyond what is necessary for account verification and linking you to your child's school records.

You are responsible for maintaining the security of your phone number and device. You must notify us immediately if you suspect unauthorized access to your account.

4. SMS and OTP Communications

By using the Service, you agree to receive SMS messages containing one-time passwords for authentication. Standard message and data rates from your mobile carrier may apply. These messages are transactional in nature and are not marketing communications.

You may stop receiving OTP messages by discontinuing use of the Service. Please note that without OTP verification, you will be unable to access the platform.

5. Acceptable Use

You agree to use the Service only for its intended purpose of accessing school-related information for your children. You may not:

• Attempt to access information about students other than your own children
• Use the Service for any unlawful or fraudulent purpose
• Interfere with or disrupt the Service or its infrastructure
• Attempt to reverse-engineer, decompile, or extract source code from the Service
• Share your account credentials or allow others to access your account
• Use automated tools to scrape or extract data from the Service

6. AI-Generated Content

The Service uses artificial intelligence to process and present school information. While we strive for accuracy, AI-generated responses may occasionally contain errors or inaccuracies. The information provided through the Service should not be considered as a substitute for official school communications.

We are not liable for decisions made based on AI-generated content. For critical or time-sensitive matters, please contact your school directly.

7. Intellectual Property

The Service, including its software, design, content, and trademarks, is owned by Devcon Solutions (Pty) Ltd and is protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable licence to use the Service for its intended purpose.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the practices described in the Privacy Policy.

9. Service Availability

We aim to provide continuous access to the Service but do not guarantee uninterrupted availability. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any loss resulting from service interruptions.

10. Limitation of Liability

To the maximum extent permitted by law, Devcon Solutions (Pty) Ltd, its directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you have paid us in the twelve (12) months preceding the claim, if any.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

Upon termination, your right to use the Service ceases immediately. Sections relating to intellectual property, limitation of liability, and governing law shall survive termination.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to this page with an updated "Last Updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the revised Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts of South Africa.
